2. Use of the App
2.1 License
We grant you a personal, non-transferable, non-exclusive license to use the app for private, non-commercial purposes.
2.2 Age Rating
Whistle1 is suitable for all ages (PEGI 3 / ESRB E). The app contains no violence, no offensive content, and no gambling elements.
2.3 Technical Requirements
To use the app, you need a compatible device and possibly an internet connection for online features such as the leaderboard or cloud storage.
3. Account & Save Games
3.1 Google Play Games
Using Google Play Games Services is optional. By signing in, you can unlock achievements and back up save games to the cloud.
3.2 Local Save Games
Save games are primarily stored locally on your device. Uninstalling the app or changing devices may result in loss of local save games.
Note: We recommend using Cloud Save to back up your save games.
4. In-App Purchases
4.1 Optional Purchases
Whistle1 is free to play. All core features are accessible without payment. Optional in-app purchases offer additional convenience features:
- Ad-Free: Removes all advertisements
- Unlimited Career: Play beyond 10 seasons
- Boosts: One-time bonuses (money, training, etc.)
- Editor: Access to the database editor
4.2 Payment Processing
All payments are processed through the respective store provider (Google Play, Steam). Their payment and refund policies apply.
4.3 Refunds
Refunds for in-app purchases are subject to the policies of the respective store provider. For technical issues, contact us at info@digitale-manufaktur-rudolstadt.de.
5. Virtual Goods
All virtual goods in the app (virtual money, items, boosts) have no real monetary value and cannot be exchanged for real money or used outside the app.
Virtual goods are tied to your device or account and are non-transferable.
6. Code of Conduct
When using the app and related services (e.g., leaderboard), the following is prohibited:
- Use of offensive, racist, or inappropriate player names
- Manipulation of save games or leaderboard entries
- Use of cheats, hacks, or modified versions of the app
- Reverse engineering or decompilation of the app
- Commercial use without written permission
Violations may result in exclusion from online features and deletion of leaderboard entries.
7. Intellectual Property
All rights to the app, including graphics, music, code, and game mechanics, belong to Digitale Manufaktur Rudolstadt or its licensors.
"Anpfiff1", "Whistle1", and "Düdük1" are trademarks of Digitale Manufaktur Rudolstadt.
8. Limitation of Liability
8.1 Availability
We strive for uninterrupted operation but cannot guarantee continuous availability of the app or online services.
8.2 Disclaimer
The app is provided "as is". We are not liable for:
- Data loss due to device changes or technical problems
- Interruptions of online services
- Incompatibilities with certain devices
These limitations do not apply to damages resulting from injury to life, body, or health, or intentional or grossly negligent conduct.
9. Changes
We reserve the right to change these Terms of Service at any time. Material changes will be communicated via the app or website. Continued use of the app after changes constitutes acceptance of the new terms.
10. Final Provisions
10.1 Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
10.2 Jurisdiction
The place of jurisdiction is Rudolstadt, Germany, where legally permissible.
10.3 Severability
If any provision of these Terms of Service is invalid, the validity of the remaining provisions shall not be affected.
